Preamble

The following General Conditions constitute the whole legal agreement between you - the Client and medagon (the "Company") and govern the use of the website at www.medagon.eu (the "Site") and the services offered on the Site (the "Services") and completely supersede and replace any prior agreements between the Client and us in relation to his use of this Site and the Services. If the Client wants to use this website or buy any products from us he must agree with the present terms and conditions. They are designed to be fair to both the Client and us. We may change these terms and conditions from time to time and any changes will be effective immediately once published on this page. You should check these terms and conditions every now and then to ensure that you are aware of and comply with the current version.

These General Conditions constitute a contract of sale between The Company and the Client. The Company provides the client with an opportunity to purchase available goods through E-shop by sending a request and payment of the purchase price, subject to compliance of the Customer to these General Conditions. The client shall make valid applications for the purchase of goods from our E-shop only after express consent and acceptance of these General Conditions. He will be considered bound by the provisions of the terms and conditions and undertakes to respect them.

The General Conditions are intended to define the terms of sale between the Client and the Company, from the moment of submitting of the order to the payment and delivery of goods.

Website Content

We will do our very best to make sure that all information on our website is accurate and up to date.

Each product is described by their basic characteristics, picture and selling price.

The colours of our products are as accurate as possible. However differences in display settings of your computer can impact the colour on your computer screen.

All products are subject to availability.

All quoted prices include VAT. Delivery charges will be added as an additional cost.

"Client" or "Customer" shall mean a natural or legal person registered in the customer profile of the E-shop who has agreed to these General Conditions. By submitting an order/application, the Client represents and confirms that he is at least 18 (eighteen) years old. The Company reserves the right to refuse an order if suspected that the Customer is under 18 years of age.

"Price" shall mean the price of the unit or specified quantity of goods, including VAT, excluding costs of delivery of the goods, unless otherwise stated.

Prices

Product prices are in Euros, US$ and British Pounds, (exchange rate of the day) with all duties and taxes included. They include VAT and any discounts applicable at the date of the order. All products will be invoiced with the relevant sales taxes and/or VAT as required by law.

The Company reserves the right to change at any time and without notice the prices of products offered on the E-shop. You will be charged based on the prices displayed on the Site at the time of placing your order, subject to availability of products ordered at this time.

Product prices are exclusive of delivery charges (shipping, packaging and manufacturing of the package according to current amounts). The amount of delivery charges will be specified on the order before confirming the order.

If one or more taxes or contributions, including environmental, are to be created or modified (increased or decreased), this change shall reflect to the selling price of the Products shown on the Website and the various sales materials.

However, a price cannot be changed once the order is validated by the Client.

Purchasing goods from our web site

Your registration

To use some of the Services, you will need to register on the Site. When you register, you will be requested to provide your personal details. In particular, in registering on the site, you must provide your legal name (corresponding to the one that appears on your identity document, if any), date of birth, phone number, email address and other requested information as indicated. Furthermore, when ordering goods, you will be required to provide payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the Billing Information provided. In all cases, you are required to provide information about yourself that is true, accurate, current and complete in all respects.

Should any of your registration information change, please notify us immediately at the following email address: [email protected]. You should also view our Privacy Policy which explains how we look after your personal information. We may change registration requirements from time to time and, should any such changes be made, these will be detailed within amended General Conditions as described above.

You will receive a username and password as part of the registration process. You are responsible for maintaining the confidentiality of your password and account and all activities that occur in connection with these. You agree to immediately notify us of any actual or suspected unauthorized use of your password or account or any other breach of security.

Your eligibility for purchase

You may make purchases from the Site only if you meet our terms of eligibility. These are:

(1) you are individual at age of 18 or older or you are authorized representative of a legal entity; and (2) you have been issued with a valid PayPal account ; and (3) you are purchasing for your own use and not for resale.

We reserve the right to refuse to supply multiple quantities of an item being shipped to any single customer or postal address.

Making a Purchase

The command

Identifying the User's prior

To place an order, the client must identify himself with his email address or customer number and password. For the first order, the Client must follow a procedure to create an account indicated on the Site.

If lost or forgotten password, the User may reapply by visiting his client account and clicking "Forgot password". He will then receive a password to the email address he provided at time of registration.

Recording and validation of the order

The User has the option to place an order online or from our online catalog.

Once the basket is validated, the Client must accept the General Conditions, choose the address and mode of delivery, and finally validate the method of payment, this last step formalizing the sales contract between the Client and the Company.

The Company acknowledges receipt of the order upon validation by sending an email.

In some cases, including non-payment, incorrect address or other problem on the Client's account, the Company reserves the right to block the Client command to solve the problem.

In case of unavailability of any ordered Product, the Client will be notified by email.

By submitting an order to us you are offering to buy a product or a number of products from us. We will confirm that we have received your offer by sending you an 'order received' email to the address you provide in the order process.

Payment terms

With your account in PayPal

By choosing payment via PayPal, the Client will be automatically directed to their PayPal account. Once payment is Paypal e validated, the Client may terminate his order on the Website.

We must receive full payment of the products before we can accept any offers. We reserve the right to refuse any offers in an order prior to acceptance. Payment is processed at the time we dispatch your order from our website warehouse and you will receive an 'order dispatch' email from us which is confirmation that we have accepted your order offer.

Communication

If we need to contact you about your order we will do so using the phone number and email address you have provided to us. If there is a problem processing your order or payment we will place your full order on hold until we receive instructions from you on how you would like to proceed. If we do not hear from you within 7 working days we reserve the right to cancel your order.

Privacy Policy

At medagon we are totally committed to protecting the privacy of our site visitors and customers. We promise not the share or sell your information to any third party, other than where it is providing a service to you as specified below. We also have security measures in place to protect our customer database and access to this database is restricted internally.

By providing your personal information to the Company, the Client consents to us recording, maintaining, holding and using his information. We use this information for the following purposes:

To arrange delivery of your order;
To undertake security checks and charge you for your order;
To send email or postal mail to you after you have purchased a product.

Your attention is drawn to the fact that we will gather, save, process and use data obtained in connection with the contractual relationship in so far as this is necessary for the proper handling of your order and processing of information.

Delivery

Delivery costs are an additional cost to the price of the product advertised on our website.

Delivery will be made with courier company or Post mail.

For the acceptance of the products, proper identification will be required and, where applicable, proof for payment. Otherwise, the ordered products may not be transferred to the Client.

Any dates we specify for delivery of products on the website or by email are approximate. We will do our best to deliver products within the times stated however we shall not be liable for any losses, costs, damages, charges or expenses caused by any delay.

Requested to purchase goods are delivered to the customer specified delivery address within the delivery time specified in the confirmation of your order.

The goods are delivered properly packed according to its type and transport delivery.

The goods shall be transmitted to the client or third person that receives and acknowledges receipt of the same on behalf of the Client by signing documents accompanying the goods. If the client is not found in the delivery period of the given address or not access and conditions for delivery of the goods within this period, E-shop is released from its obligation to deliver the product to the Client. The Customer can confirm their willingness to receive the goods after expiry of delivery, which was not found at the address, assuming all costs of re-delivery. In this case begins appropriate new delivery time from the moment of confirmation under the preceding sentence.

Cancellations and Returns

If you find that any product which you have ordered is unacceptable, we have a flexible returns policy.

You may cancel your order or return to us any full priced product within 15 days of the date printed on your dispatch note. Sold items must be returned within 15 days of the date of dispatch. If you receive a faulty product this may be returned to us within any reasonable time.

You have the option of returning by a request for exchange any product purchased on the Site within fifteen (15) calendar days from the date of delivery, the following conditions: products must be returned with their purchase invoice, or a copy in case of partial return in their original condition and packaging, to the Company’s address. When returning products, you must attach the original copy of the order or a copy of it if you fail to return a portion of the order.

Refunds and Exchanges

Please note that if you choose to return any sale items to our E-shop, we cannot offer a cash refund, only a credit note to the value of the product.

We will gladly send out any exchange to you free of charge.

If you request a refund, we will refund the amount paid for your products to your payment card within 30 days of receiving your return. However, the money may take more days to reach your account as this is dependent on your bank.

Customer Satisfaction

We warrant that our products will be of satisfactory quality and fit as represented on our website. If you are dissatisfied with our products or service in any way, please contact us on the website. We aim to deal with all enquiries fairly, confidentially and quickly. We will acknowledge your contact within 24 hours. We try to resolve most issues immediately, but where this is not possible we will keep you informed about progress until we have achieved a satisfactory resolution.

Intellectual Property

You agree to acknowledge that we own or are licensed to use all copyright, database rights, trademarks and other intellectual property rights in and to all parts of this web site, and to the business of the Company, including the structure, design and layout of the web site.

You are entitled to use our web site in accordance with these General Conditions only. You must obtain our prior written consent before you use our web site or any part of it in any other manner.

You may link to our homepage provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website not owned by you.

The product designs and product materials used for our products and all drawings, models, illustrations, images, audio, text, logos, brands are exclusive property and are protected by applicable copyright and other proprietary rights and laws. You are not authorized to reproduce, sell or otherwise use these designs or materials, in whole or in part.

Any reproduction or redistribution of the Content is not authorized and may result in civil and criminal penalties.

Applicable law and arbitration

The General Conditions are subject to Greek laws.

NoWarranty

The Company cannot guarantee or represent that the website is free from viruses, crash data, Trojan horses or other destructive material.

The site may contain technical inaccuracies or other defects, does not guarantee the correction of these defects. The website and content of this site is presented "as is" and "as available" basis.
